You didn't buy the car from a Seat dealer.
You haven't had it fully Seat dealer serviced.

I'm not surprised really.

On a 4 year old car with 30k on you'd have thought they'd have done something!
If the car has been serviced correctly within schedule it shouldn't matter whether it was bought private or not.
Seat UK sold the car when new.
As they're part of VW who are replacing engines as they know the tensioner is a problem hence it's been revised several times and is still problematic.
Totally disgusting outcome.

If the car has been bought private and not been serviced by a seat dealer they are well within there rights to not do anything

Contract is with the dealer that sold the car not SEAT UK

I know it's not what you want to hear

May want to contact vrs Northampton as I believe they have a 2nd hand tsi engine in stock and should be a lot cheaper

Not sure how a service (by seat, or anyone else for that matter) would pick up a tensioner which hadn't failed yet....... good luck pal!

there's some engines £2,000 fitted on ebay with a 6 month warranty. I know it's no cheap but still a damn sight better than what seat quoted

Complained and now offered, 30% contribution so £3600 for me to pay??? 30% of 6240 doesn't equal that? Oh well, still not happy so will be chasing up with evidence of "not fit for purpose"

Sale of Goods Act 1979 (as amended)

I am writing with regard to the very disappointing response I have received from SEAT UK related to the known catastrophic engine fault I have suffered. I own a SEAT LEON FR which I purchased on 5th February 2011 for £14,000, (from Knights BMW in Stafford) having waited months for my local dealer Clarks of Kidderminster to locate one in white with the appropriate specification. Given the full SEAT dealer service history that the car came with and the limited mileage of 11,000miles I was delighted with the purchase. The car has a maintained service history with Clarks of Kidderminster and they have been very accommodating over the years but I have needed to return the car to them on several occasions due to on-going issues with a ‘rattling’ sound, which they were neither able to identify the cause or rectify.

I write to you as this vehicle is not fit for purpose due to the following problem:
The vehicle fails to start due to the defective nature of the timing chain tensioner. The timing chain was able to slip due to the failure of the tensioner causing the chain to be loose during the start-up of the car. This has caused the inlet camshaft to slip two teeth causing a timing change to the engine which has resulted in contact of valves with pistons rendering the engine non-functional. The vehicle has done 33,000miles and holds a full service history with VAT registered companies (including 75% of them being at a SEAT main dealer).
The vehicle was towed to the nearest garage by an AA recovery vehicle as it would not start. Upon investigation the problem was identified as a defective tensioner. The car was recovered to the Kidderminster SEAT main dealer for investigation who have then issued a bill of £6,240 for a repair. The part in question is a component that should last for the lifetime of the vehicle and therefore is expected to not fail and as such should be covered by SEAT under the sale of goods act.

This fault has been documented on a number of different online forums throughout the VAG related to this specific engine and has been identified via the ELSA electronic documentation as:

TPI 2024485/5 Transaction No.: 2024485/5 Damage of timing chain tensioner Release date: 27-Jun-2011

This is clearly a known fault with the CCZA engine, the fact that the part should be expected to last for the duration of the life of the vehicle, that it is not a serviceable part and that it causes catastrophic damage to the engine is a serious issue and as such is not fit for purpose.

The Sale of Goods Act 1979 (as amended) states that goods should be as described, of a satisfactory quality and fit for the purpose intended. As the SEAT LEON is not, I would like to reject the goods and request that the item be fixed to a suitable state of repair at the earliest opportunity and provide me with a courtesy vehicle also at the earliest opportunity.

Plus, as a consequence of the defective component I have incurred extra costs for identification of the repair and towing totalling a sum of £279.27 plus the diagnosis from SEAT of £142 and I ask that you reimburse me the additional £421.27 to cover these costs and the cost of my time in making this complaint and being without a vehicle.

My young family have been without a car since this has happened. I have found that SEAT UK have to date been of little empathy which is a complete disappointment to me, given that from research other VAG companies who use the same engine seem to have had much better dealings with their customers with this fault under similar circumstances.
SEAT UK have offered 30% of the parts/labour bill given that there are three SEAT stamps in the book. I would dispute that this is unreasonable given that the car has only done 33k miles and the service is fully up to date. There is only one service which is my legal right to have completed elsewhere due to the long wait to book in at the closest dealership. The law prevents me from being penalised for exercising this right, yet SEAT UK are clearly penalising me for doing so.
The underlying fact remains that the part (which has been redesigned since the production date of the car in light of engine failures) is not of satisfactory quality to fulfil the function/purpose of the car and that it is not a serviceable part making the SEAT service stamps irrelevant to this matter.

Thank you for your e-mail regarding your case with SEAT Customer Services. I was sorry to read that you believe that little empathy has been shown in relation to your case. I am very familiar with your case and the situations resulting in the failed component; please be assured I have attempted to assist with every option available to me.
I am aware you feel that the part should last for the lifetime of the vehicle and should be covered under the Sale of Goods Act.
However, because of the complexity of modern vehicles, it is impossible for any manufacturer to offer a lifetime for a component. Moreover, many external factors beyond the manufacturer's control can affect the longevity and serviceable life of any vehicle or part. Nevertheless, we do offer a three year Manufacturer's Warranty because we feel its is reasonable to expect any manufacturing defects to become evident in this time.
When the Manufacturer's Warranty has expired, any repair costs become the responsibility of the vehicle's owner and there is no legal obligation on SEAT UK to offer goodwill a contribution. When assessing whether goodwill can be offered, we consider a number of factors which include the customer's loyalty to our brand and any offer is a reflection of this loyalty rather than an admission of liability. After investigating your issue, I was able to offer a goodwill contribution of 30 per cent in acknowledgement of your loyalty to our brand.
I appreciate that you have been advised of technical product information (TPI) relating timing issues. However, this is not evidence of any manufacturing defect; the purpose of the bulletin is to assist our dealers to make a quick and full diagnosis of a potential adjustment to the tensioner. Had the tensioner materials or their production been defective, the product would have been changed and the modified component listed in the 'Production change' section of the TPI. As there is no information in this section, this confirms that the component is fit for purpose.
In relation to The Sale of Goods Act 1979 and your desire to reject the vehicle, I can advise that your contract of sale is with the company or individual from whom you purchased the vehicle, not with SEAT UK. I can therefore only recommend that you express your desire to reject the vehicle to the seller. I hope this email is suitable and offers you a full response; however, if you require further clarification, please do not hesitate to contact me on the number below.

So I guess it's off to an independent garage to get fixed (SEAT/Cossie/Scooby/Mitsi Rally prep guy said it was 'a piece of piss to fix' and 'what a joke they want £6k, bring it to me') s I'm hopeful.

Thank you very much SEAT I will NOT be purchasing another branded car ever again, should have stuck to Jap. Good luck to all those with the 'fit for purpose' TFSI engines, ticking time bomb they clearly aren't (I must just be an unlucky one) as hardly any other VAG engines have gone pop (32 I have found on forums so far) clearly not an issue and the tensioner is clearly 'fit for purpose' for the lifetime of the car with no servicing needed... hummmmm???

VERY pee'd off to be honest... :(

Will let you know how much of my hard earned dollar it costs to fix when it eventually does...

How come they offered a good will and then retracted that offer?

I imagine it is disappointing although it is understandable if the vehicle was not bought from a main dealer or have full main dealer history.

Seat are horrendous when it comes to goodwill or warranty.
They wouldn't do a warranty repair on my R with only 9k on and in warranty.
I liked the Seat product but the customer care and dealers are in a world of their own.
It's an expensive problem to put down to experience for which you must be gutted!
Get it fixed then decide whether to keep it or get rid.

I don't think there too bad goodwill wise. I got 70% cover when m turbo went and was 6 months out of warranty however FSH and the manufacturer of the turbo covered the rest.

Look of the draw to be honest however if you case it's madness how they won't cover it all or atleast 75%.
