My insurance company for previous cars did think it was a modification.
Performance gains are minimal to a standard car - althought air does flow more efficiently without the drop in flow a normal paper element has it gets dirtier and dirtier.
Main advantage for me is the cost - cheaper to run over 3 years than conventional filters
