Worst case,they issue a prohibition notice & they put your car on a transporter & take it away until you collect it on a trailer & get the 'defect' repaired

Realistically they'll test it, fail it, give you a prohibition notice & make you go to an MOT place to get it rechecked within 7-10 days.

ooooopppppsssss ... got caught speeding today! :( Pulled out to overtake, squeezed the throttle, overtook, pulled back in, suddenly blue lights behind me from an unmarked silver BMW. Police said I went from 55 to 84 in a few seconds. Major downside of a responsive, powerful car eh! First time I've ever been done for speeding in 26 years of driving. Been referred to the procurator fiscal, most likely get 3 points and a £60 fine.

I fail to see why they have a case. I passed a mobile van at 80+ when overtaking but as I slowed down when I was out of danger I wasn't breaking the law. Gift cops if they do you for this. I would imagine the PF will throw it out.

It's not as if I was drunk driving like a maniac, all I did was pull out, overtake then pull back in. I hope they do throw it out.

I would definitely argue it, just be a pain at the least, you've got nothing to lose. Normally if you take it far enough they drop it because it's not worth their while.

Good luck though, let us know how you get on.

rob if you need a good lawyer or barrister in these matters give me a shout , i had a very scary situation myself and managed to get it quashed , with the help of a great few people behind me , if not id defiantly argue it , as im aware your allowed to speed up to overtake :shrug:

Speed limit was 60 (national speed limit sign?) and I overtook at 84. That's why I didn't get a ticket there and then, because I was 24mph over the speed limit, so it has been sent to the PF. The officer did say that it would be most likely I'd get 3 points and a £60 fine.

BUT this site shows a dual carraigeway bearing the national speed limit sign, the speed limit is 70mph?

I don't condone speeding nor deny I was over the speed limit, but it was only an overtaking manouver that lasted no more than 10-15 seconds.

Rob, was it on a dual carriageway? If so it is a 70mph speed limit and shouldnt be a court case?

I was caught speeding when i was 18 and had to go to court, got a solicitor involved which prevented me getting a ban - 5 points and a fine but i was well over the speed limit.

If it does go to court argue you need the car for your livelyhood - no convictions for 26 years, pulled out to overtake and pulled back in to speed limit etc and i doubt you will see a ban.

Do they have evidence of your speed on a camera or anything?

Without evidence of a speed reading i dont see how a court will put it in their favour.

Have they got proof you were doing 84MPH, surely if you were overtaking you'd of only been doing that speed for a few secounds so they would'nt be able to get a accurate speed reading.

rob ask to see the calibration certificate for the car on the day it happened ;) boss done this and the couldnt or wouldnt come up with it so he got off with it :D

Id just wait for the letter to come through about a court date then if it does go to court get legal aid and they will advise you on whats best to do but you dont have to agree but usually pleading guilty at the earliest point reduces the charge as you know yourself you are caught if you saw evidence. Not trying to put you down or anything mate but its the law and unfortunately nice people like yourself do suffer happened to me last month aswell but i was lucky and managed to get 1 charge dropped!
