if its fitted from standard then it must be present and working, i think the MOT book states cars after X year should have belts fitted. Therefore i am sure if they can't find a belt it will fail...

End of the day, if your carrying kids you are going to replace it anyway !

take them out, the seats the belts etc as mork has said before they cant test what isnt there

The rules state - each seat must have a seat belt for cars past 19xx

So if you can't fix the belt in time, take the rear seat bench out & they cannot fail it.

however, you should fix it asap, as it is an offence to drive a car not capable of passing an MOT (at any time)

my car will be MOT'd with one seat just to be sure [B)]

Mmm,

Sorry to detract (slightly) from your problem gb, but I have just fitted car seat covers to the rear bench which completely cover the middle seat belt. I never have anyone in the back at all nevermind the middle so don't mind not having this belt - but from the above it seems I will fail my MOT (which is this week). Is this right?

Yup, it should fail.

Just remove the covers?

I think you could even be as cheeky as to fold (and secure with a bungy) the rear seats down.
