Positive deviation, 94.9% duty cycle etc. Limp mode issues

Right the car goes into limp after being pushed really hard for a while. If i'm driving normally up and down the motorway even with the occasional foot down into high speeds it's fine but if I go for a proper hoon it will sometimes pop into limp mode.

Fault code was positive deviation.

The car has an 18 month old hybrid turbo that's been mapped by AMD and all has been well. It also had a new MAF sensor at the same time. The car also has an EGR blank and mufflectomy (SP?)

Occasionally when WOT you feel a slight flat spot at around 3.5k, also I'm suddenly experiencing more lag than I used to.

I logged 11 on the Vag-com and noticed that the duty cycle seemed to stay at 94.9 for most of the rev range.

I can't see/hear any boost leaks.

Any suggestions? I'm thinking the wastegate may be siezed?
