Damage caused by dealers.

I ve booked my LCR in for its first service since it was bought new in Jan 06. After not having a great experience with the dealer I bought it off regards a few warranty niggles and reading the damage people have had done to their cars while in for a service I m now on the wary side.

Has anyone ever come across a standard legal form, similar to a hire car agreement, where the dealer will sign to say they received the car in its existing condition and will be liable for any damage caused while its in their premises i.e from "test drives" , car park bumps and dinks and car washing etc.

I just want something that puts the onus back on the dealer to do a decent job and take a bit of care while they are doing it. I know they say they will cover it, but I dont even want to get into that position.

I ve tried Google but found nothing relating to this type of situation.

Somthing similair to that paint reading sheet would be good.
You draw a similair diagram and go round with the service manager making a note of each mark etc on the panels and then both sign to say that was the only damage. Both of you get a copy and then go round it together when the job is done.
Only way you can both agree that no damage is done.

When you book her in take the reception person around the car and tell them to look over it pointing out theres no dents, no curbs etc and say "Are you happy you have recorded everything and there are no defects" then if the do damage it they have to replace/fix it.

I had major problems with letchworth seat, every time it went in (4 times in total) it got damaged, the lone before last i had the man look around the car first as the last time they had said prove it wasnt there before. Surfica to say they scratched it again but agreed to fix it, the only trouble was it was just a touch up pen and it stood out like a sore thumb. I now avoid the dealer like the plauge as even if they agree to fix it its the point they did it in the first place!

I take photos of my car just prior to it going into service or maintainance. I try and take the photos on a circle around the car starting from the front left ending the front right. This way I have a series of pics going from the front left to the front left wheel and so on, so if curbing accures they can't say "oh thats the rear passenger side" sorta thing. Plus on my camera I have the time stamp feature so the pics are a pretty good indication of the damage or lack of before going to such places.
Ideally getting the people who are performing whatever function to your car to admit the state of the car before and after will be the hardest thing. If they do then they have legally obliged themselves to maintain the same standard vehicle that they have recieved.

Scotty B you let them touch it up, should have been a respray at the bodyshop of your choice etc.

Re the form, you need to be careful, as when you pick it you you need to mark note any faults, any you find after that they would knock back.

The thing you have to remember is if they will not pay up when they have damaged your car, sue them!!!!! will cost you about £50 to do this and you most likely will get paid out

Edited: i was moaning about a dealer who has just damaged my LCR alloy, will wait till they say what they will do about it before posting details however they did not accept liability straight away suggesting they may not have done it (but they have!!!!)
